SaaS marketing costs and budget guide for England: payroll on-costs, ICO fee and PECR consent lines you can source

SaaS marketing cost lines for England: £12.71 National Living Wage, 15% employer National Insurance, 3% pension minimum, ICO fee tiers and email and cookie consent.

What to take away

  • The National Living Wage is £12.71 an hour from April 2026 for workers aged 21 and over.
  • Employer National Insurance is 15% above the £5,000 yearly secondary threshold for 2026 to 2027, and the minimum employer pension contribution is 3%.
  • The ICO data protection fee is £52, £78 or £3,763 depending on size.
  • Marketing emails to individuals need specific consent, with a narrow soft opt-in for your own customers.
  • Agency, advertising and tool prices come from quotes, so this budget marks them as such.

Which cost lines can be sourced

A SaaS marketing budget mixes lines set by law with lines set by suppliers. The first kind can be checked at source. The second kind needs a dated quote.

Payroll: the pay floor and employer on-costs

The National Living Wage is £12.71 an hour from April 2026, for workers aged 21 and over. The rate for ages 18 to 20 is £10.85. These are legal floors, not market salaries, so use them as the lowest line in a staffing budget.

Employer National Insurance for 2026 to 2027 is 15% for category A, B and C employees, and the employer rates and thresholds put the secondary threshold at £5,000 a year. Employer National Insurance is paid to HMRC as part of the PAYE bill.

Employers must also pay into a workplace pension. The minimum employer contribution is 3% of earnings, within a total minimum of 5% with the employee's share.

Example: one marketing hire on one basis

This is illustrative arithmetic. The £40,000 salary is an invented placeholder, and pension is shown at 3% of the whole salary as a simple upper estimate.

LineCalculationAmount
SalaryPlaceholder£40,000
Employer National Insurance(£40,000 minus £5,000) times 15%£5,250
Employer pension£40,000 times 3%£1,200
Total employer costSum of the three lines£46,450

The on-costs add £6,450, or about 16% of salary, before equipment, software seats and recruitment fees. Replace the placeholder with a real offer, and see the hidden costs article for lines teams miss.

A floor check for the lowest rate: 37.5 hours a week for 52 weeks is 1,950 hours, and at £12.71 an hour that is £24,784.50 a year before on-costs.

Compliance: ICO fee, email and cookies

Organisations that use personal information pay a data protection fee unless exempt. Tier 1 covers a maximum turnover of £632,000 or no more than 10 members of staff, at £52. Tier 2 is £78, and everyone else pays the tier 3 fee of £3,763.

Email is where SaaS marketing meets the law most often. You must not send marketing emails or texts to individuals without specific consent, under the ICO email marketing guidance.

Sole traders and some partnerships are treated as individuals. The soft opt-in rule means you may be able to email or text your own customers, but it does not apply to prospective customers or new contacts, for example from bought-in lists.

The rule itself sits in regulation 22 of the Privacy and Electronic Communications (EC Directive) Regulations 2003. For websites, you must tell people if you set cookies and clearly explain what they do and why. Consent must be freely given, specific and informed.

Document the lawful basis for each dataset before use. Review email marketing benchmarks only after the consent route is clear.

Budget method

  1. List every line and mark it Sourced, Quote or Placeholder.
  2. Replace each Quote with a dated supplier figure.
  3. Add on-costs to every salary using the rates above.
  4. Add the ICO fee tier and consent tooling.
  5. Test the total against a CAC benchmark and keep it in a budget template.

Checklist

  • National Living Wage and employer rates dated and checked.
  • Employer National Insurance and pension added to every salary line.
  • Agency, media and tool lines marked as quotes.
  • ICO fee tier confirmed.
  • Consent route written down for email and cookies.

Common questions

How much should a SaaS company spend on marketing in England?

No source here sets a percentage, so treat any percentage as an assumption and test it against your own payback target.

Is an agency cheaper than hiring?

Compare a written agency quote with the full employer cost from the example above, which includes National Insurance and pension.

Do I need consent to email business contacts?

Sole traders and some partnerships are treated as individuals, so specific consent or the soft opt-in applies to them.

What changes if the hire is part time?

Scale the salary, then apply the same method. Employer National Insurance still depends on earnings above the £5,000 yearly secondary threshold, so a smaller salary has a smaller on-cost.
